To submit a photo or video of your “Cigar Cave,” go to www.partagascigarcave.com and follow the on-screen directions to register and submit your photo or video. You must be 21 years of age or older to submit a video. PHOTOS AND VIDEOS ARE NOT REQUIRED FOR, NOR ARE THEY PART OF, THE PARTAGAS “CIGAR CAVE” CONTEST. PHOTOS AND VIDEOS WILL NOT BE JUDGED. Follow the on-screen instructions for uploading your photo or video (herein “Submission”). If your Submission is a video, it must not exceed 90 seconds in length and must be in .avi, .mov, or .mpg format. If your Submission is a photo, it must be as a JPEG/JPG (500k or less).

Submission must be your sole and original creation; your sole property; and must not infringe upon any other person’s rights. Person depicted in the Submission must be you. No other person(s) other than you may be visible. The right to submit or use a Submission must not be restricted in any way. Modifying, enhancing or altering a third party’s pre-existing work does not qualify as your original creation. Submission must meet the following criteria or may result in its removal, in General Cigar Co., Inc.’s (“Sponsor”) discretion:

• Submission cannot be sexually explicit or suggestive, violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane or pornographic, contain nudity or any materially dangerous activity;
• Submission cannot promote illegal drugs or firearms (or the use of any of the foregoing), or any activities that may appear unsafe or dangerous, or any particular political agenda or message;
• Submission cannot be obscene or offensive, endorse any form of hate or hate group;
• Submission cannot defame, misrepresent or contain disparaging remarks about Sponsor or its products, or other people, products or companies;
• Submission cannot contain trademarks, logos owned by others, or advertise or promote any brand or product of any kind, without permission, or contain any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses;
• Submission cannot contain copyrighted materials owned by others (including photographs, sculptures, paintings and other works of art or images published on or in websites, television, movies or other media) without permission;
• Submission cannot contain materials embodying the names, likenesses, photographs, or other indicia identifying any person, living or dead, without permission;
• Submission cannot communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate; and
• Submission cannot depict, and cannot itself, be in violation of any law.

Notwithstanding anything in these terms and conditions to the contrary, Submissions will not include any of the following content: (i) pornography, adult-oriented content or any other sexually-explicit material;(ii) explicit language or content, images of violence, discrimination, or promotion of illegal activities; (iii) content in violation of third party rights including, but not limited to: copyrights, including music copyrights, trademark right of publicity or any other proprietary rights (other than those of Sponsor); (iv) libelous, defamatory, disparaging, tortuous or slanderous materials; (v) content that denigrates, disparages or reflects negatively on (a) the Sponsor, or (b) any person, company, product or service; (vi) illegal drugs or firearms; (vii) dangerous stunts; (viii) material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, age or any other basis protected by federal, state, or local law, ordinance, or regulation;

(ix) audio and/or visual content owned by any third party (e.g., recorded music; pre-produced video, etc.); and (x) material that is unlawful, in violation of or contrary to the laws or regulations in any state where the Submission is created. Any Submission that does not comply with the foregoing, in the sole discretion of Sponsor and/or the applicable entities, as applicable, may be disqualified.

Your Submission grants General Cigar Co., Inc. and its designees the right to publish, use, adapt, edit and/or modify the Submission in any way, in commerce and in any and all media now known or hereinafter developed, throughout the world, in perpetuity, without consideration, permission, or notification to you, except where prohibited by law. Your Submission further constitutes your consent to irrevocably assign and transfer to the Sponsor any and all rights, title and interest in and to the Submission including, without limitation, all intellectual property rights. Submission will constitute and signify your agreement and consent that Sponsor and/or Sponsor’s assignees may use the Submission, name, photograph, or likeness for promotional purposes in commerce and in all media worldwide now known or hereinafter developed without time limitation and without further compensation, except where prohibited. Sponsor reserves the right to take such action as it deems necessary to enforce these Terms and Conditions, including without limitation barring anyone who does not comply with them.

LIMITATIONS OF LIABILITY: Neither Sponsor nor its agencies are responsible for any incorrect or inaccurate information, whether caused by Website users, or by any equipment or programming and assume no responsibility for any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of Website. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds may be tampering with the operation of this Website, may be acting in violation of the terms of the Website or may be acting in a disruptive manner, or with intent to threaten, abuse or harass any other person. Any attempt to deliberately damage any Website is unlawful and subject to legal action by Sponsor or its agents.

IN NO EVENT WILL SPONSOR, ITS AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF ENTRANTS ACCESS TO AND USE OF THE INTERNET SITE OR DOWNLOADING FROM AND OR PRINTING MATERIAL DOWNLOADED FROM SAID SITE. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE SITE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
